New NLRB Rules Hurt Businesses

In the past month the National Labor Relations Board formally adopted new rules which drastically hurt businesses by modifying representation and case handling procedures. The new rules go into effect April 30, 2012.

The Board adopted several provisions which limit an employer’s ability to challenge a unit’s appropriateness, penalize an employer if it does so, and essentially removes the Board from any involvement in a representation case until after an election takes place. This limits an employer’s free speech and due process rights by restricting its ability to communicate with employees after learning of union activity.

An employer’s ability to challenge a bargaining unit prior to an election is practically eliminated. With the inclusion of a reduced election period (potentially less than 25 days if units are challenged) the employer has a greatly reduced ability to educate employees on the costs and impact associated with joining a union once it is notified of an organizing effort.

Communication and training are key to avoiding the pitfalls associated with union organizing drives. Under the new rules, if you wait until a recognition petition arrives, it is already too late. Many times an organizing drive can be thwarted before it begins if you give employees an opportunity to learn the truth about organized labor.

Merry Christmas and Happy New Year!

Christmas for my family has always been surrounded by anticipation. Welcoming family and friends on a frigid Christmas Eve in Chicago. Waking up and being pulled out of bed by my little girl excited to see what was under the tree. Enjoying the feeling of being in Church with those I hold most dear, rejoicing in the birth of Jesus.

Christmas is also about redemption and hope. All of us remember those who sacrifice and those who suffer, especially at this time. The men and women far from their loved ones sacrificing their special moments with their own family on Christmas, sacrificing so much so that we can be free. Others are hurting financially, not knowing where their next paycheck may come from.

Christmas gives us a reason to come together to step out into the world and make it better. As 2012 fast approaches, we know that together, we can make a difference for our Country and touch those who are hurting the most, to give them hope. I am excited about what the New Year will have in store, and the prospect of working with each and every one of you to make a positive impact on the lives of those who live in our County.

Rubio: It’s Time To Hold Obama Accountable

Rubio: “The last thing job creators in America need is more uncertainty from a powerful government agency like the CFPB that will receive a blank check for a half billion dollar budget with virtually no input from Congress.

Governor Scott Releases Budget

Today, as promised, Governor Scott has released a budget that is balanced, has no new taxes, and makes important programs like education a priority. Republican leaders in the legislature and Governor Scott have demonstrated their ability to work together and protect Florida’s taxpayers while keeping essential investments for the future of our state a priority. With an almost $15 trillion national debt, it is painfully clear that Washington has a serious spending addiction. America’s economic situation is a result of decades of overspending and Washington’s inability to stop. Not only is this addiction racking up a massive credit-card bill that you, the taxpayer, have to pay back, it is placing obstacles in the way of a struggling economy. With nearly 14 million Americans out of work, Congress and the White House should focus on working together to get our economy back on track and address the root of our nation’s economic crisis: overspending.

As a result of Washington’s addiction, deficit spending has skyrocketed; $459 billion in fiscal year 2008, $1.4 trillion in fiscal year 2009, $1.3 trillion in fiscal year 2010, and $1.3 trillion in fiscal year 2011. In just the past couple of years alone, since President Barack Obama took office, the national debt has increased by $4 trillion. To paint a clearer picture for you, it took the United States 216 years, from 1776 until 1992, to accumulate the same amount of debt that the nation has borrowed in just over 2.5 years. If we choose to follow the fiscal path outlined by the president’s 2012 budget, in just 10 years, 95 percent of all federal taxes will be used to pay off our debt and fund programs like Social Security and Medicare. This will leave only 5 percent of our annual tax revenue for funding national defense, veterans, and other essential functions of the government.

America is drowning in debt. Yet, instead of addressing the bad policies that led our nation into this fiscal mess, President Obama has called for more spending and raising taxes by an estimated $1.5 trillion. At a time when America is facing a debt crisis, an unemployment crisis and a spending crisis, increasing taxes and continuing to spend money we don’t have will only make things worse. Additionally, this massive new spending plan threatens to keep our economy on its current downward trajectory. While the president says these massive new taxes would only impact “millionaires and billionaires,” 75 percent of America’s job-creating small businesses file as individuals.

Fortunately, the antidote to Washington’s spending addiction is simple: passing a legally binding amendment to the Constitution. A balanced budget amendment would constitutionally limit the ability of Congress to spend more than it takes in. While spending cuts and caps are only temporary and left up to Washington politicians to enforce, a constitutional amendment is permanent. Currently there are 49 states, including Florida, that abide by some form of a balanced budget requirement, and it is time for Congress to do the same.

Fifteen years ago, Congress was on the verge of passing a balanced budget amendment. The amendment passed the House with bipartisan support, but lost by one vote in the Senate. Since then, the debt has grown by $9.8 trillion and the need for a balanced budget amendment has only become more urgent.

Knowing this, my colleagues in the House and I ensured that as a part of the August debt limit agreement, the House and Senate would vote on a balanced budget amendment to the Constitution. This vote will be taking place before Dec. 31. To pass the House and Senate, this constitutional amendment would require a two-thirds majority in both bodies (290 representatives, 67 senators). If passed, the amendment would then be sent to all 50 states for ratification.

Ronald Reagan once said, “We’ve tried the carrot, and it failed. With the stick of a balanced budget amendment, we can stop government’s squandering, overtaxing ways, and save our economy.” Over the next couple of months, Congress will have the opportunity to do what is right for our country. Let’s save our economy by passing a balanced budget amendment to the Constitution.

Mica Committed to Restoring Our Economy

Dear Friends:
As I get back to the district and talk to folks, I hear from those that have lost their job and people who now have lower incomes and lower expectations for their children’s future. This greatly concerns me. I have listened to the President, along with my constituents and others, and while the President has some ideas that merit consideration, our biggest point of difference is that just implementing bigger government programs and more spending are not going to get America out of a depressed economy.

We must incentivize those that invest and those that create jobs. It is the private sector that can expand employment and reinvigorate the economy. It has been free enterprise and business that makes the country go and grow. These free market principles provide good paying jobs and then allows people to pay their taxes and be good citizens. We must find ways that promote that private sector activity and also to compete and win today in a global market. More regulations, more taxation and more meddling from Washington only depress positive economic growth.

In Congress, everyone has different responsibilities—mine is transportation and infrastructure. In this role, I am trying to make certain that the money you pay when you fill up your tank through the gas tax or the other federal fees and taxes you pay, are properly expended on good infrastructure. America’s roads, bridges and all types of transportation and infrastructure systems need attention. It is imperative that we use your hard-earned tax dollars, the money that you are sending to the highway trust fund, properly. With 35 percent of the Stimulus I funds appropriated two and a half years ago still in Washington, the term “shovel ready” has become a joke. We must streamline the federal project approval process, cut red tape and end wasteful programs.

I am looking for ways to do more with less like many citizens have had to do. So in the U.S. House Transportation and Infrastructure Committee, my responsibilities have been to work in our area to move projects forward and expand employment opportunities to build our nation’s infrastructure. I am willing to work with the President, Democrats, Republicans and citizens that come forward with great ideas that we can incorporate into good policy. We can and we must do better.

I am optimistic about the country’s future. I think people working together with good intentions and good faith, can make a difference. America has risen to any challenge in the past, and I know that we can in the future.

Adams Calls on Senate Democrats to Move Past Politics

Representative Sandy Adams (FL-24) released the following statement today as Senate Democrats and President Obama continue to refuse to pass a troop funding bill or come to an agreement on a bill to fund the government for the remainder of the fiscal year. The Democrat-led Congress failed to pass a budget last year, and now they continue to stand idly by as House Republicans work to keep the government running at responsible budget levels.

“It is extremely troubling that Senate Democrats and the Obama Administration are playing politics at the expense of the American people and our military men and women. After failing to lead during the previous Congress and pass a budget, the same Democrats have once again shown that they are incapable of leading this country into anything other than astronomical debt. Their opposition to the troop funding bill – which passed in the House with bipartisan support yesterday – or any long-term budget solution the House has brought to the table, is proof-positive that Senate Democrats are more concerned about political posturing than the American people they were elected to represent.

“It is time for Senate Democrats to take responsibility and admit that they failed to lead this country last Congress, and do their jobs by passing this troop funding bill and the House passed long-term budget plan, H.R. 1. Our nation is facing a fiscal crisis, and it is imperative that Congress addresses it immediately. The American people sent a resounding message to Congress last November that they want it to get its fiscal house in order. House Republicans have listened and are doing everything they can to keep the government running at responsible budget levels, and it is time the Senate follows suit.”
